Terms of Service

These website terms govern use of the Bernstein Digital website. Individual client projects are governed by the written proposal, scope, invoice, agreement, or other terms accepted for that project. If those project documents conflict with these website terms, the project documents control.

Website information

Website content is provided for general informational and marketing purposes. Bernstein Digital may change services, pricing, package details, availability, or website content at any time. Starting prices shown on this website are not binding quotes.

Project inquiries and proposals

Submitting a planner, audit request, or contact form does not create a client relationship or obligate either party to begin work. A project begins only after the applicable scope, price, payment terms, responsibilities, and start conditions are accepted.

Client responsibilities

Clients are responsible for providing accurate information, timely feedback, required access, legally usable text and media, and any approvals needed for their business or industry. Delays in content, access, payment, or approval may change the schedule.

Payments, domains, and third-party costs

Payment schedules are stated in the project documents. Domain names, premium domains, paid plugins, advertising, stock assets, email services, third-party software, transaction fees, and other external costs are separate unless expressly included in writing. Domain pricing and availability can change without notice.

Revisions and additional work

Included revisions and deliverables are defined by the accepted project scope. New pages, features, integrations, content, redesign requests, or other work outside that scope may require a separate estimate or change order.

Ownership and portfolio use

Ownership and licensing are defined in the project agreement. Unless otherwise agreed, Bernstein Digital retains ownership of pre-existing tools, reusable code, frameworks, processes, and licensed third-party materials. Client-specific deliverables transfer only as stated in the agreement and after required payments are completed. Portfolio use will be handled honestly and will not include confidential information.

SEO, performance, and business results

Bernstein Digital does not guarantee a particular search ranking, traffic level, number of leads, revenue result, uptime percentage, or approval by a search engine, directory, advertising platform, affiliate program, or third-party service. Results depend on many factors outside Bernstein Digital’s control.

Third-party services

Websites may depend on hosting companies, WordPress, plugins, APIs, search engines, email providers, payment processors, analytics tools, and other independent services. Bernstein Digital is not responsible for outages, policy changes, discontinuation, account decisions, security incidents, or failures caused by those providers, though reasonable assistance may be offered under the applicable support plan.

Acceptable use

You may not misuse this website, attempt unauthorized access, interfere with operation, submit malicious code, scrape protected information, impersonate another person, or use the forms for spam, unlawful activity, harassment, or fraud.

Limitation of liability

To the fullest extent permitted by law, Bernstein Digital is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of this website. Any liability relating to paid services is subject to the limitations stated in the applicable project agreement.

Governing law

These website terms are governed by the laws of the State of South Dakota, without regard to conflict-of-law principles. Any project agreement may contain additional dispute-resolution or venue provisions.

Changes and contact

These terms may be updated periodically. Continued use of the website after changes means the current terms apply. Questions can be submitted through the Bernstein Digital website planner.
